SportsTech Japan, Inc. (the "Company") establishes the following privacy policy (this "Policy") regarding the handling of users' personal information in the services provided on this website (the "Service").

Article 1 (Personal Information)

"Personal information" means "personal information" as defined in the Act on the Protection of Personal Information, and refers to information about a living individual that can identify the specific individual by the name, date of birth, address, telephone number, contact details, or other descriptions contained in such information, as well as information that can identify the specific individual from that information alone, such as data relating to appearance, fingerprints, or voiceprints, and the insurer number of a health insurance card (personal identification information).

Article 2 (How Personal Information Is Collected)

The Company may ask users for personal information such as their name, date of birth, address, telephone number, email address, bank account number, credit card number, and driver's license number when they register for use. The Company may also collect transaction records containing users' personal information and information concerning payments, made between users and partners or others, from the Company's partners (including information sources, advertisers, and advertising distribution destinations; "Partners") and other parties.

Article 3 (Purposes of Collecting and Using Personal Information)

The purposes for which the Company collects and uses personal information are as follows.

  1. To provide and operate the Company's services
  2. To respond to inquiries from users (including verifying their identity)
  3. To send users emails with information about new features, updates, campaigns, and the like of the service they are using, and about other services provided by the Company
  4. To contact users as necessary, such as for maintenance and important notices
  5. To identify users who have violated the terms of service or who seek to use the service for wrongful or improper purposes, and to refuse their use of the service
  6. To allow users to view, change, and delete their own registered information and to view their usage status
  7. To bill users usage fees for paid services
  8. Purposes incidental to the above purposes of use

Article 4 (Changes to the Purposes of Use)

  1. The Company shall change the purposes of use of personal information only where the changed purpose is reasonably recognized to be relevant to the purpose before the change.
  2. If a purpose of use is changed, the Company shall notify users of the changed purpose, or publish it on this website, by the method prescribed by the Company.

Article 5 (Provision of Personal Information to Third Parties)

  1. The Company will not provide personal information to third parties without obtaining the user's prior consent, except in the following cases. However, this does not apply where permitted under the Act on the Protection of Personal Information or other laws and regulations.

    1. Where the provision is necessary for the protection of a person's life, body, or property, and it is difficult to obtain the consent of the person concerned

    2. Where the provision is particularly necessary for improving public health or promoting the sound development of children, and it is difficult to obtain the consent of the person concerned

    3. Where it is necessary to cooperate with a national government organ, a local government, or a person entrusted by either of them in performing the affairs prescribed by laws and regulations, and obtaining the consent of the person concerned is likely to interfere with the performance of those affairs

    4. Where the following matters have been announced or published in advance and the Company has filed a notification with the Personal Information Protection Commission

      1. That the purposes of use include provision to third parties
      2. The items of data to be provided to third parties
      3. The means or method of provision to third parties
      4. That provision of personal information to third parties will be stopped at the request of the person concerned
      5. The method for accepting requests from the person concerned

  2. Notwithstanding the provisions of the preceding paragraph, in the following cases the recipient of the information shall not be deemed a third party.

    1. Where the Company entrusts all or part of the handling of personal information within the scope necessary to achieve the purposes of use
    2. Where personal information is provided in connection with the succession of business due to a merger or other cause
    3. Where personal information is used jointly with a specific party, and the Company has, in advance, notified the person concerned of, or placed in a state where the person concerned can easily learn, that fact, the items of personal information to be used jointly, the scope of the joint users, the purposes of use of those users, and the name of the person or entity responsible for the management of that personal information

Article 6 (Disclosure of Personal Information)

  1. When the Company is requested by a person to disclose their personal information, the Company will disclose it to the person without delay. However, where disclosure would fall under any of the following, the Company may decline to disclose all or part of the information, and if the Company decides not to disclose it, the Company will notify the person to that effect without delay. A fee of 1,000 yen per request will be charged for the disclosure of personal information.

    1. Where disclosure is likely to harm the life, body, property, or other rights or interests of the person concerned or a third party
    2. Where disclosure is likely to significantly hinder the proper conduct of the Company's business
    3. Where disclosure would otherwise violate laws and regulations

  2. Notwithstanding the provisions of the preceding paragraph, the Company will not, in principle, disclose information other than personal information, such as history information and characteristic information.

Article 7 (Correction and Deletion of Personal Information)

  1. If a user's own personal information held by the Company is inaccurate, the user may request that the Company correct, add to, or delete the personal information ("Correction, etc.") in accordance with the procedures prescribed by the Company.
  2. If the Company receives a request from a user under the preceding paragraph and determines that it is necessary to respond to the request, the Company shall make the Correction, etc. of the personal information without delay.
  3. If the Company makes a Correction, etc. under the provisions of the preceding paragraph, or decides not to make a Correction, etc., the Company will notify the user without delay.

Article 8 (Suspension of Use, etc. of Personal Information)

  1. If the Company is requested by a person to suspend the use of or erase personal information ("Suspension of Use, etc.") on the ground that the information is being handled beyond the scope of the purposes of use or that it was obtained by wrongful means, the Company will conduct the necessary investigation without delay.
  2. If, based on the results of the investigation under the preceding paragraph, the Company determines that it is necessary to respond to the request, the Company will carry out the Suspension of Use, etc. of the personal information without delay.
  3. If the Company carries out a Suspension of Use, etc. under the provisions of the preceding paragraph, or decides not to carry out a Suspension of Use, etc., the Company will notify the user without delay.
  4. Notwithstanding the preceding two paragraphs, where a Suspension of Use, etc. would require a large expense, or where it is otherwise difficult to carry out a Suspension of Use, etc., and alternative measures necessary to protect the user's rights and interests can be taken, the Company shall take those alternative measures.

Article 9 (Changes to this Privacy Policy)

  1. The contents of this Policy may be changed without notice to users, except for matters otherwise provided for by laws and regulations or in this Policy.
  2. Except as otherwise determined by the Company, the changed privacy policy shall take effect from the time it is posted on this website.
